Important notes
- Germany does not have a wealth tax. The Vermogensteuer (wealth tax) was suspended in 1997 following a ruling by the Federal Constitutional Court (Bundesverfassungsgericht). Although it remains in the constitution (Art. 106 GG), it has not been levied since.
- Inheritance/Gift Tax (Erbschaftsteuer/Schenkungsteuer): Germany taxes inheritances and gifts with rates from 7% to 50% depending on the relationship (Tax Class I) and amount. The exemption for spouse/registered partner is €500,000.
- The gift tax exemption resets every 10 years, allowing strategic lifetime gifting. Business assets may qualify for up to 85% or 100% exemption under certain conditions.
- Other wealth-related taxes in Germany include: Solidarity Surcharge (Solidaritatszuschlag), Real Estate Transfer Tax (Grunderwerbsteuer), and Property Tax (Grundsteuer).
